Types of Information Collected

We collect different types of information through the Website.

1.        General Information

Personal Information is information about you that can be used by itself, or combined with other information, to personally identify you. Personal Information may include all or some of the following, depending upon whether the specific information can be used or combined to personally identify you: Review Information, Account Information, Booking Information, Event and Service Information, and Purchase Information. We collect this information directly from you when you provide it to us and by any and various means. For example, when you request information from us, contact us through our Website, submit information through our Website, or make purchases through our Website, you may provide some or all of the following information to us:

  • ·      Booking Information: if you book a session with us through our Website, we may collect the following information from you in addition to Account Information and Purchase Information:
  • o  information related to the session (such as date, time, attendees, topic, etc.); and
  • o  information in response to a session questionnaire.
  • ·      Review Information: When you submit a review through our Website, we may collect the following information from you, as well as other optional information:
  • o  first and last name;
  • o  phone number;
  • o  email address;
  • o  mailing address;
  • o  comments, feedback, review information;
  • o  screen name/username/preferred name associated with the review; and
  • o  information about product and/or service purchases you have made.
  • ·      Event and Service Information: in addition to all the types of information detailed above, if you are inquiring about hiring us to provide services to you (including but not limited to, photography, videography, social media work, podcast editing, website and web design etc.), we may collect the following information as well:

This Personal Information has been collected to provide products, services, and information to you in response to your request.

2.        Specific to the Website

When you submit a request for information, book any type of session, purchase or subscribe to receive goods or services, or place an order through our Website, we may collect Personal Information, Account Information, and/or Purchase Information, which we may use to create an Account for you.  We use Account Information to create, manage and maintain Accounts, fulfill orders, and provide services through the Website.


3.        Automatically as You Navigate the Website (log files, cookies, and other technologies)

When you use or visit the Website, we may automatically record and store certain information in log files. Generally, we use this information in an aggregated and anonymized way (“Aggregated Data”). If we need to combine this type of information with Personal Information, we treat it as Personal Information. Automatically collected information includes statistical or technical information such as your Internet Protocol address, operating system, time and date, your location, how long you spend on the Website, and how you navigate the Website.

On our Website, we may, depending on your cookie preferences, also collect information through the use of "Cookies" or similar tracking technologies, which are identifiers transferred to your browser. Each user’s IP address may be logged with each visit and each action performed on the Website. IP address information is linked to Personal Information and may be used to block a “banned” user from accessing the Website.

4.        Email, Surveys, and Your Choices

If you have provided us with your contact information, we may use this information to communicate with you about your order, purchases, booked sessions, payment, and/or Account, or to address and answer your questions. If you have given us consent by providing your contact information to us, we may, subject to your marketing preferences, send you education, marketing, product/service support, and research emails/surveys. Our third-party mail service provider provides us with anonymized and aggregated information about the respondents to our emails. You can unsubscribe from our marketing and research emails anytime by following the instructions included in them. We may track open rates for our emails so we can improve our communications with you and our services. If you participate in our optional surveys, information you provide to us, including Personal Information, may be linked with your Account. We will not share the Personal Information you provide through a contest or survey with third parties unless we give you prior notice and choice. Some of our Services may include links to third party websites or apps. We are not responsible for such websites. These sites may have their own privacy policies and practices.


5.        Social Media & Contests

We have or may have a presence on various social media platforms, such as Facebook®, Instagram®, Twitter® (or “X”). We may receive anonymized and aggregated demographic and use information from these services when you engage with us on them. In addition, we may offer sharing features and other integrated tools (such as the Facebook® "Like" button). Such integrated features may share data and are governed by the privacy policies of the third parties that provide these features. From time to time, we may conduct contests and sweepstakes. If you participate, we may collect information from you, as described in the terms of the contest or sweepstakes.


How We Use This Information

We use information that we collect about you or that you provide to us, including any Personal Information, as described throughout this Notice, including to:

•               Provide information to third-party payment processers to process payments that you make through our Website;

•               Personalize and customize your experience, content, marketing, and recommendations;

•               With our affiliates or subsidiaries, provided the data is adequately protected. Also, if we are acquired, dissolve, or go through a change of control, Personal Information could be one of the assets transferred, subject to your consent, where required by law.

•               To fulfill the purpose for which you provide it (for example, when you want to share something to social media, to post it to a third-party account on your behalf), for any other purpose disclosed by us when you provide the information, or otherwise with your consent.

•               To comply with relevant laws, regulations, lawful requests by public authorities, including to meet national security or law enforcement requirements, court orders, and legal process; protect and defend the rights or property of us or third parties and investigate and prevent fraud; and in an emergency, including to protect safety.

We also may freely disclose Aggregate Data to third parties for research and development, product and service development and improvements, and other related business purposes.


You may opt to pay for products and services through our Website. We utilize third-party payment companies for processing all payments. We will share your Personal Information, including billing and payment information, with these third-party payment companies to process payments made through our Website. You should review the privacy policies of all such third-party payment processing companies as well.


Our Website Operates Exclusively in the United States

While our Website is viewable for information purposes only in foreign countries, our Website does not target customers in countries outside of the United States, nor do we do business in any countries outside of the United States. Additionally, we do not target or knowingly collect information on children under 18-years of age. To submit Personal Information to us and/or to make purchases through the Website, you are confirming that you are at least 18-years of age.

Accessing Your Information, Your Rights, Opt-Out Rights

Upon request, we will provide you with information about whether we hold any of your Personal Information.  You can contact us at legal@thoseinmotion.com or through the contact information provided below to correct, modify, request a copy of, or request deletion of this Personal Information or your Account.

We will use commercially reasonable efforts to respond to your request within 30-days unless such request is unreasonable under or would violate applicable law. If you request to delete Personal Information, you may no longer be able to use some features of the Website.

We will retain information for as long as your Account is active, as long as you are utilizing our products and services, or as necessary to provide services to you. We may also be required to keep some of your Personal Information for legal reasons, for instance to comply with statutory retention periods or for tax purposes. In addition, we will continue to retain and use Aggregate Data.


OPT-OUT RIGHTS.

We offer certain choices about how we communicate with you and what information we obtain.

•          You may opt-out of receiving emails at any time by clicking "unsubscribe" in those emails.

•          You can delete cookies on your browser.

  • To opt-out of automated decision making.

To exercise any of these opt-out rights via email, you must put “Opt-Out Rights” in the subject line of your email for these communications and include your name, address, and email address in the email along with an explanation of which right(s) you are exercising. We reserve the right to ask for additional information to confirm your identity before disclosing any Personal Information with you.

Security

We take reasonable precautions to protect your data. California, Nevada, and Other States Privacy Rights

Our Website is available to residents in all fifty states. We recognize that the privacy laws of the various states are changing constantly. While we endeavor to keep current on the laws of individual states, the information in this Notice is current as of the date on the Notice.


The following information and terms in this California, Nevada, and Other States Privacy Rights section supplements the information and terms contained in the rest of this Privacy Notice. We reserve the right to ask for additional information to confirm your identity prior to responding to any request. Please note that we will not accept requests via the telephone or by facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.


"Do Not Track" Signals: We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
